Description

This collection of two volumes covers landmark judgments in Maltese Constitutional and Administrative Law. Although not completely separate, the two subjects form distinct areas of law. The judgments on Constitutional law, though mainly based on post-independence jurisprudence, cover as well the pre-independence period, and  also landmark judgments delivered by the Maltese courts in defiance of arbitrary power under colonial rule before and during the Second World War. Most cases, however, deal with modern human rights law and the key cases and judgments which have given this law its modern aspect and form. The second volume covers the leading cases in administrative law, mostly relating to the grounds of challenging public authorities under judicial review of administrative action, both before and after the enactment of article 469A of the Code of Organization and Civil Procedure. The judgments cover topics such as excess of authority by a public entity, breaches of the rules of natural justice and abuse of power; as well as procedural issues relating to judicial review cases.
